1. About these terms

1.1 These Terms and Conditions ("Terms") govern your use of peachandpebble.store (the "Website") and every purchase you make from us. "Peach and Pebble", "we", "us" and "our" mean Peach and Pebble FZ LLC, a company licensed in Dubai, United Arab Emirates, "You" means the person using the Website or placing an order.

1.2 By using the Website or placing an order, you confirm that you have read and accept these Terms, our Shipping Policy, our Returns and Refunds Policy and our Privacy Policy, which form part of these Terms.

1.3 You must be at least 18 years old, or the age of legal majority where you live, and legally able to enter into a binding contract to place an order.

1.4 These Terms are available in Arabic and English. If there is any difference between the two versions, the Arabic version applies.

1.5 We may update these Terms from time to time, for example to reflect changes in the law or in how we operate. The updated Terms will be posted on this page with a new "Last updated" date. The Terms in force when you place an order are the Terms that apply to that order; changes do not affect orders already placed.

1.6 Nothing in these Terms limits or excludes any right you have under UAE consumer protection law that cannot be limited or excluded by agreement.

2. Accounts, orders, prices and payment

Your account

2.1 You may check out as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly if you believe your account has been used without your permission.

2.2 You agree to give us information that is true, accurate, current and complete, including your name, email, phone number and delivery address, and to update it if it changes.

Placing an order

2.3 Placing an order is an offer to buy the products in your basket. After you order, we will send you an email acknowledging it. A contract between us is formed only when we confirm that your order has been dispatched, or when we otherwise confirm acceptance in writing.

2.4 We may decline or cancel an order before it is dispatched, for example if a product is out of stock, if we cannot verify your payment or details, if we suspect fraud or resale, or if there is an obvious pricing or description error. If we cancel, we will tell you and refund any amount you have paid in full, using your original payment method.

2.5 We may limit the quantity of any product per customer, household or order.

2.6 You may cancel an order free of charge at any time before it is dispatched by contacting us. Once an order has been dispatched, our Shipping Policy applies.

Prices

2.7 All prices are shown in UAE Dirhams (AED) and include VAT at the applicable rate. Delivery charges, if any, are shown at checkout before you pay. The price shown at checkout is the final price you pay.

2.8 We do not charge any extra fee for paying by credit or debit card or by any other payment method we offer.

2.9 Prices may change from time to time, but a change will not affect an order you have already placed.

2.10 Any discounts, sales or promotions are subject to the specific terms published with them and to any approvals required by the competent authorities. Discount codes cannot be exchanged for cash and, unless stated otherwise, cannot be combined.

Payment

2.11 Payment is taken when you place your order, through the secure payment methods shown at checkout. Card payments are processed by our third-party payment providers; we do not see or store your full card details.

2.12 We will issue a digital invoice for every order, showing the products, prices, VAT and delivery charges.

3. Our products

3.1 We sell baby and children's apparel and accessories. Each product page shows the product's description, materials, sizing, care instructions and country of origin.

3.2 Sizing. Age ranges and size guides are a general guide only, as babies grow at different rates. Please check the measurements in our size guide before ordering. A product that does not fit can be exchanged or returned under our Returns and Refunds Policy.

3.3 Colours and images. We take care to show products accurately. Colours may look slightly different depending on your screen settings, and small variations in colour, pattern placement or texture can occur, particularly with natural fabrics. These variations are not defects.

3.4 Safe use. For your child's safety, please:

• check every item before use and remove all tags, labels, pins and packaging;
• inspect items regularly for loose buttons, snaps, threads, ribbons or other small parts, and stop using any item that is damaged;
• never leave a baby unattended while wearing items with ties, cords, bows or small accessories, and do not use such items for sleep;
• follow the care instructions on the label, and wash new items before first wear.

3.5 Accessories such as headbands, hair clips and bows are not toys and should only be worn under adult supervision.

3.6 Products are for personal use only and not for resale.

3.7 We may update product descriptions, discontinue products or change our range at any time. This does not affect orders already accepted.

4. Shipping and delivery

4.1 We deliver within the United Arab Emirates, using licensed courier partners. Estimated delivery times and charges are shown at checkout and in our Shipping Policy. Delivery dates are estimates, not guarantees.

4.2 Your delivery address. You are responsible for providing a complete and correct delivery address at checkout, including building or villa number, street, area, emirate and a phone number on which you can be reached.

4.3 If an incorrect or incomplete address is provided, your delivery may be delayed. If you notice a mistake after ordering, contact us as soon as possible. We will do our best to update it before your order ships, but please expect a delay while we reroute your order.

4.4 We are not able to offer refunds or compensation for delivery delays caused by an incorrect or incomplete address, or by the recipient being unavailable or unreachable at the time of delivery.

4.5 Failed delivery. If our courier cannot deliver after reasonable attempts because of an incorrect address or because you could not be reached, the order may be returned to us. We will contact you to arrange redelivery, and you may be asked to pay the redelivery charge. 

4.6 Risk and ownership. The products become your responsibility once they are delivered to the address you gave us, or collected by you or someone on your behalf. Ownership passes to you when we have received full payment.

4.7 Check your parcel. Please check your order on arrival. If the parcel is damaged or an item is missing or incorrect, tell us within 48 hours of delivery, with photos where possible, so we can put it right quickly. This does not affect your rights for defective goods.

4.8 We are not responsible for delays caused by events outside our reasonable control (see section 6.7). 

5. Returns, exchanges and refunds

Faulty, damaged or incorrect items

5.1 If an item you receive is defective, damaged or not what you ordered, you may choose a replacement, a repair where suitable, or a full refund, including the original delivery charge. We will collect the item or cover the cost of returning it. Please contact us with your order number and photos of the issue.

Change of mind and size exchanges

5.2 If you change your mind or need a different size, you may return or exchange items within 14 days of delivery, provided that they are:

• unworn, unwashed and in the same condition as when you received them;
• free of stains, odours, pet hair or perfume;
• returned with all original tags, labels and packaging attached.

5.3 Because our products are worn close to a baby's skin, we cannot accept change-of-mind returns of items that have been worn, washed or had their hygiene seal or tags removed. 

5.4 The following cannot be returned for change of mind: items personalised or made to your specification; earrings, pacifiers, teethers and other items worn in or on the mouth or pierced skin, once opened; and gift cards.

5.5 For change-of-mind returns, the customer pays the return delivery cost unless we agree otherwise. The original delivery charge is not refunded.

5.6 To start a return or exchange, contact us within the return window with your order number. Returns sent without contacting us first may be delayed.

Refunds

5.7 We will inspect returned items and let you know the outcome. Approved refunds are made to your original payment method within 14 days of our receiving the item. Your bank or card provider may take additional time to show the credit.

5.8 If a returned item does not meet the conditions in 5.2, we may decline the refund and return the item to you, or deduct a reasonable amount to reflect its reduced value. We will explain why.

5.9 Refunds are not available for delivery delays caused by an incorrect or incomplete address, as set out in section 4.4.

5.10 Items bought in a sale or with a discount code are refunded at the price actually paid.

6. Liability, intellectual property and use of the Website

Our responsibility to you

6.1 We guarantee that products we sell are free from manufacturing defects and match their description when delivered. If they are not, section 5.1 applies.

6.2 To the fullest extent permitted by UAE law, we are not liable for:

• loss or damage caused by misuse, failure to follow care or safety instructions, normal wear and tear, accidental damage, or alterations made after delivery;
• loss or damage that was not reasonably foreseeable when the contract was made;
• business losses, as our products are for personal use only;
• delays or failures caused by incorrect information you provided.

6.3 To the fullest extent permitted by UAE law, our total liability to you for any order is limited to the price you paid for that order.

6.4 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under UAE law.

Intellectual property

6.5 All content on the Website, including the Peach and Pebble name and logo, product photos, designs, text and graphics, belongs to us or our licensors. You may view it for personal shopping only. You may not copy, reproduce, sell or use it commercially without our written permission.

Acceptable use

6.6 You must not use the Website to: break any law; provide false or misleading information, including false names, addresses or payment details; place fraudulent orders or make abusive chargebacks; harass, threaten or abuse our staff or other customers; upload viruses or harmful code; scrape, copy or interfere with the Website or its security; or infringe anyone's rights. We may suspend or close accounts, cancel orders and refuse future orders where we reasonably believe these Terms have been breached, and we may report suspected fraud to the authorities.

Events outside our control

6.7 We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, public holidays, courier or customs disruption, strikes, government action, network outages or public health emergencies. We will tell you as soon as possible and do what we reasonably can to reduce the delay. If the delay is lengthy, you may cancel and receive a full refund for products not yet delivered.

Reviews and content you share

6.8 If you post reviews, photos or comments on our Website or tag us or message us on social media, you confirm that the content is your own, accurate and lawful, and you give us a free, non-exclusive licence to use, edit and display it in connection with our business. We will ask your permission before using any image that shows a child's face. We may remove content that we consider inappropriate.

Third-party links

6.9 The Website may link to third-party websites, apps and payment services that we do not control. We are not responsible for their content, products or privacy practices.

Indemnity

6.10 You agree to compensate us for any loss, claim or reasonable cost we suffer as a direct result of your breach of these Terms, fraud, or misuse of the Website, to the extent permitted by law.

7. Privacy, law and contact

Your personal data

7.1 We collect and use your personal data to process orders, arrange delivery, provide customer service and, where you agree, send you marketing. We handle it in line with Federal Decree-Law No. 45 of 2021 on Personal Data Protection and our Privacy Policy, which explains your rights and how to exercise them.

7.2 We share your details only with those who need them to fulfil your order, such as our courier partners, payment providers and e-commerce platform. You can unsubscribe from marketing at any time using the link in our emails.

Communications

7.3 You agree that we may communicate with you electronically, including by email, SMS and WhatsApp, about your orders. Electronic confirmations and invoices have the same effect as written ones.

Complaints and disputes

7.4 If you have a problem, please contact us first. We aim to respond within 2 working days and to resolve complaints quickly and fairly.

7.5 If we cannot resolve a complaint, you may contact the Ministry of Economy's consumer protection department or Dubai Economy and Tourism's consumer protection service.

7.6 These Terms and any order are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute that we cannot resolve together will be subject to the jurisdiction of the courts of Dubai, without affecting any right you have to bring a claim in another competent UAE court.

General

7.7 If any part of these Terms is found to be invalid or unenforceable, the rest of the Terms will remain in full effect.

7.8 If we do not enforce a right under these Terms straight away, we can still enforce it later.

7.9 These Terms, together with the policies referred to in section 1.2, are the entire agreement between you and us about your use of the Website and your orders.

7.10 You may not transfer your rights under these Terms to anyone else without our written consent.
